Welcome to Peak Fitness Dieppe! These Terms and Conditions govern your use of our facilities, services, and programs, including group fitness memberships, personal training, nutrition services, digital services, community events, and SMS messaging. By purchasing any service or participating in any program, you agree to abide by these Terms and Conditions.

1. Introduction
Welcome to Peak Fitness Dieppe! These Terms and Conditions govern your use of our facilities, services, and programs. By participating in any program, you agree to abide by these terms.
2. Definitions
Key terms used in this agreement are as follows:
- Membership: Access to group fitness classes based on selected plans, including monthly, 6-month, or 12-month memberships, as well as punch passes and drop-ins.
- Legacy Membership: Membership plans no longer available, including All Access, and Bootcamp memberships.
- Personal Training: One-on-one training sessions led by a personal trainer.
- Small Group Personal Training (SGPT): Training sessions for 2 to 4 participants led by a personal trainer.
- Nutrition Services: Programs like the Ignite Program, Basic, and Premium packages, and other personalized coaching services.
- Community Events: Challenges, workshops, and seminars hosted by Peak Fitness or Peak Nutrition.
- Punch Pass: A pre-paid pass granting access to 8 classes, valid for 3 months from the date of purchase.
- Drop-In: Single access to a group fitness class.
- SMS Messaging / SMS Program: Text messages sent by Peak Fitness Dieppe to a mobile phone number you provide and opt into, including transactional, informational, and (where consented) marketing messages.
3. Membership Policies
Membership policies include:
- Monthly, and Legacy Memberships require a 30-day cancellation notice in writing. To cancel your membership, contact us at info@peakfitnessdieppe.ca.
- 6-month and annual memberships require forfeiture of 30% of the monthly fee for the remaining months of the agreement if canceled before the term ends, with the following exceptions: if the member moves outside of the Greater Moncton area (which includes Dieppe, Moncton, Riverview, Shediac, and surrounding areas) or if the member provides notice from a doctor, physiotherapist, or other registered health professional.
- Punch Passes expire 3 months from the date of purchase and are non-refundable.
- Drop-ins provide single access to a class and are non-refundable.
4. Hold Policy
Our hold policies include:
- For Legacy and Good Plan Memberships, a $15 fee applies to place the membership on hold, for a maximum of 2 weeks.
- For Better Plan and Best Plan memberships, you can place your membership on hold for a maximum of 2 weeks without any fees.
- If a hold longer than 2 weeks is needed, the membership will need to be canceled, following the membership policies noted above.
- For Legacy memberships, rejoining will require purchasing a current membership plan.

5. Group Fitness Classes
Class schedules are subject to change. Advanced booking is recommended. Cancellations should be made as early as possible to allow others to participate.
6. Personal Training Policies
Personal Training and SGPT policies include:
- To cancel a personal training agreement, client will forfeit 30% of the remaining sessions on the agreement, if canceled before the term ends, with the following exceptions: if the client moves outside of the Greater Moncton area (which includes Dieppe, Moncton, Riverview, Shediac, and surrounding areas) or if the member provides notice from a doctor, physiotherapist, or other registered health professional.
- Cancellations of sessions with less than 12 hours’ notice will result in forfeiture of the session.
- SGPT proceeds if at least one participant attends. The remaining participants not in attendance will forfeit the session.
7. Nutrition Services
Refunds are not available once a program has started. Sessions canceled with less than 24 hours’ notice are forfeited.
8. Community Events
Participation in events may require pre-registration and fees. Refunds are only issued if the event is canceled by Peak Fitness or Peak Nutrition.
9. Media Consent
By participating in Peak Fitness services, you consent to being photographed or videotaped. Images may be used for marketing purposes unless you notify us in writing.
10. Member Responsibilities
Members are expected to arrive on time, provide accurate health information, and adhere to the Code of Conduct.
11. Code of Conduct
To ensure a safe, respectful, and enjoyable environment for all members, the following Code of Conduct must be adhered to:
- Respect all members, staff, and guests. Discrimination, harassment, or inappropriate behavior will not be tolerated.
- Use equipment responsibly and adhere to gym etiquette, including wiping down equipment after use and returning weights to their designated areas.
- Wear appropriate fitness attire and footwear at all times.
- Follow all safety guidelines and instructions provided by staff or trainers.
- Ensure personal belongings are kept in your vehicle or designated areas. Peak Fitness is not responsible for lost or stolen items.
- Report any damaged equipment, injuries, or safety concerns to staff immediately.
- Refrain from using mobile devices for phone calls in workout areas to respect others' experience.
Failure to comply with the Code of Conduct may result in suspension or termination of membership without refund.
12. Peak Fitness Rights
We reserve the right to modify schedules, terminate memberships for violations, and offer promotions with specific terms.
13. Liability Waiver
Participation in fitness activities involves inherent risks. Peak Fitness is not liable for injuries, illnesses, or damages.
14. Digital Services
Use of third-party apps is subject to their terms. Peak Fitness is not responsible for technical issues or data breaches.
15. SMS Messaging
Peak Fitness Dieppe may offer SMS/text messaging (“SMS Messaging”) for service, informational, and (where you consent) marketing purposes. By providing your mobile phone number and opting in, you consent to receive text messages from Peak Fitness Dieppe.
- Types of messages: Messages may include class reminders, schedule updates, service notifications (ex: closures), account-related updates, educational content, promotions, offers, and invitations to events or consultations.
- Consent & opt-in: You will only receive marketing text messages if you have provided express consent (for example, by checking an opt-in box on a form, completing a double opt-in, or signing up through an approved method). Consent to receive SMS messages is not a condition of purchase.
- Frequency: Message frequency varies based on your relationship with Peak Fitness Dieppe and the type of messages you opted into.
- Costs: Message and data rates may apply based on your mobile plan and carrier. Peak Fitness Dieppe does not charge you for receiving SMS messages, but your carrier may.
- Opt-out: You can unsubscribe from marketing text messages at any time by replying STOP. After you opt out, you may receive one final confirmation message. If you opt out, you may still receive essential service/transactional messages where permitted by law (for example, critical schedule changes), unless you also request to stop all texts.
- Help: Reply HELP for assistance, or contact us at info@peakfitnessdieppe.ca.
- Delivery: SMS delivery is subject to carrier availability and network conditions and is not guaranteed. Carriers are not responsible for delayed or undelivered messages.
- Eligibility: By opting in, you confirm you are the account holder or have permission to enroll the number provided, and you are at least 18 years old (or have a parent/guardian’s consent).
- Third-party providers: We may use third-party providers (such as SMS platforms and messaging aggregators) to send and manage SMS messages. These providers may process your phone number and messaging data solely to deliver and manage the service.
- Privacy: For information about how we collect and use personal information (including phone numbers), see our Privacy Policy.
- Changes to the SMS Program: We may change our sending number, message types, frequency, or the SMS program at any time. Continued participation after changes are posted constitutes acceptance of those changes.
- Quiet hours: We aim to send non-urgent marketing messages during reasonable hours (typically between 9:00am and 8:00pm Atlantic time). Service-related messages may be sent outside these hours when necessary.

Your personal information is collected solely for the purpose of providing services. Refer to our Privacy Policy for details.
17. Updates to Terms and Conditions
We may update these Terms and Conditions periodically. Significant changes will be communicated via email or app notifications.
